Abstract The transplant of State-based systems in Africa depends on two factors: land property law and the incompatibility between Western legal systems, based on private property, and African ones, based on communities. African land property law is a good example of the specificity and the resistance of traditional law to changes. It also constitutes a good test for evaluating the dynamics of traditional law in Africa. In fact, it is evident that the contrast between the “imported” law and the traditional local law is not the result of an unaccomplished democratic transition, but is rather rooted in the opposition between two different autonomous systems of authority. |
