Abstract The author gives an overview of constitutional theories concerning the concept of constitutional “fraud”. These theories developed during the 20th century in Europe and then widely circulated in Latin America. As a result the term “fraud” has been used in very different cultural and historical contexts, as for example Germany, during the Weimar Era; Mexico, Constitution of 1917; France, under Vichy; and Venezuela, under Chavez. However, two issues need to be addressed with regard to theories upholding “fraud”: first, the capability of a constitutional system to self-induce their own validity through amendment procedures; second, the fact that Constitutional statements have to be very clear in order to avoid any manipulation of the Constitutional amendment procedure in terms of form and purpose. |
