Abstract Constitutional sanctions can only be analysed from an historical perspective because they follow the evolution of forms of government. Constitutional sanctions have been classified as “typical” when they are based on a “triadic” structure, i.e. when a third subject carries out a jurisdictional function in relation to a violation of the Constitution, and are classified as “constitutional law sanctions” when they are based on a “binary” structure, i.e. when they are a direct consequence of the political dynamics resulting from the interaction of different parties. Nowadays this classification is overcome because the supranational legal systems exert too great an influence on domestic constitutional law. However, the Author stresses that in countries that have experienced recent transition to democracy the need find a balance between institutions still appears to be a condition for the development of any other kind of sanction. |
