Abstract The Author addresses the different meanings of modern and contemporary constitutional law in order to identify its essential and recurrent elements. He then points out the distinguishing features of English, French, and American constitutionalism. He devotes special attention to the liberal and to the democratic conception of Constitution, thus also tracing the different influences on the social contract, on institutionalism and on the idea of positive and natural law. The author concludes by discussing the conflict between constitutional review for the protection of rights (neoconstitutionalism) and popular legitimacy, procedural guarantees, and the majority rule in modern constitutional States. |
