Abstract The author analyzes the Brazilian debate on the concept of devido processo legislativo. This concept represents an original theoretical formulation to discuss the perspectives of the country development. Particularly, the thought of Marcelo Cattoni and the Habermas’ philosophical politics influence are recalled. As a matter of fact, devido processo legislativo means democratization of the exercise of the representative power in order to avoid from the one hand, the judicial activism on the single cases, and on the other hand, discussions on the constitutional theory not practised in society. |
