Abstract

The Author compares the Constitution rules of the Russian Federation of 1993 as far as the control of constitutionality and legitimacy of rules is concerned – with a particular attention to the administrative acts (the so called «ministerial law») that have actually taken over the role of federal law and of the Constitution itself – with some sentences of the Constitutional Court which deny or limit considerably the possibility to remove resolutions detrimental to citizens’ rights and freedoms. In order to avoid going back to the pseudo-juridical scheme of the Soviet system, in which the controller (the Authority) cannot be controlled, a serious meditation is required on the hierarchy of the sources of law, on the division of jurisdiction amongst different levels of judges, and the creation of an efficient system of administrative justice.
