Abstract

The international customary law provides for the principle of the immunity of the foreign Head of State from the jurisdiction. Anyway this principle is subject to some exceptions, in case of an involvement of the Head of State in the international crimes commission (war crimes, crimes against humanity and genocide). As for this kind of infractions, the socalled “functional immunity” is excluded for the Heads of State like for any other public official. The socalled “personal immunity” is instead likely to subsist, even in case international crimes should have been committed. Such a form of immunity can be considered to be a necessary and sufficient measure of protection for the Heads of State who are in charge, since it provides them with immunity until the end of their duties. This solution takes into consideration both the need to repress very serious crimes and the one to grant an ordinary taking place of the international relations, apart from some statements made in this article.
