Abstract

The article examines and explains how and to what extent the Charter of Fundamental Rights of the EU has recognized and given legal foundation to the protection of social rights. In the opinion of the author, although presenting several features to the contrary, the Charter deserves to be acknowledged as the only European source ensuring the same legal value as well as the same remedial protection to both welfare rights and civil and political rights. The importance of such an acknowledgement is underlined through a comparative and historical reconstruction of constitutional welfare rights, aimed at explaining the reasons for their problematic inclusion within the category of fundamental rights with due relevance to the current economic and social environment.
