Abstract In this paper we discuss recent developments in the Supreme Court’s jurisprudence concerning the right of assembly. We first introduce the leading cases on this topic, then we focus on the Dale case of 1999 where the Supreme Court recognized that an association has the right to exclude those members whose presence in the association collides with the values advocated by it. We finally argue that in the future this rationale could put a serious burden on the application of state antidiscrimination laws, in particular on those concerning private universities. |
