Abstract The article analizes the Spanish local electoral system in the light of the organic law n. 5 of 1985, taking into consideration the characteristic elements of the system and the guarantees of the right of participation on a local basis. The attention is particularly focused on the profiles of the passive and active electorate, on the lists of candidates and on the forms of financing the electoral campaign. Furthermore, as for the guarantees, a particular importance is given to the special contentious recourse before the administrative judge and to the Recurso de Amparo before the Constitutional court. |
