Abstract As a consequence of the reform of the fifth Title of the Italian Constitution, parliamentary law, to the benefit of regional law, loses its status as a source of law having general jurisdiction; the legitimacy of Community integration, as it has come about until now, has been confirmed; State law, just as regional law, from now on shall be required to comply with international obligations, independently of the domestic reception of the latters (as a result, a significant shifting of power towards the Government shall come about). International norms thus continue to require domestic implementation, but the provisions implementing international agreements become interposed rules within the context of judgments of constitutionality. The attribution of power to the Regions to make treaties, in matters falling under their legislative jurisdiction, and to give them implementation in any event requires State rules governing the instances and manner of their making and the authority in substitution of the State. |
