Abstract In the “biotech century”, the difficult attempt to find a balance between the protection of rights and technological innovation has increased the procedural character of Constitutions in expectation of a new equilibrium of values based on the evolution of the so-called material constitution. To support his theory the Author underlines the appearance of principles of precaution, information, participation etc all of which have found an emblematic application in the recent transgenic maize case. |
