Abstract The Author addresses the system of legal sources of the European Union by especially focusing on the Treaty of Lisbon. In fact, the draft Treaty of Lisbon on one side recalls a great part of the content of the Constitutional Treaty, but on the other side provides for a larger number of derogations to be granted to certain Member States. In particular, some Member States can now opt out from the implementation of major provisions of the Treaties in force thus leading to a weakening of the cohesion of the European Union. In conclusion, the Author also stresses the positive aspects of the Lisbon Treaty by mentioning that the simplification of the hierarchy of legal sources and procedures will have positive repercussions on the Union’s system. |
