Abstract Although the Charter of Fundamental Rights of the European Union was proclaimed in Nice back in December 2000, it has once become a current topic. The Treaty of Lisbon makes a cross-reference to the Charter (as adapted at Strasbourg on 12 December 2007) and provides for it to have the same legal effect as the Treaties. However even if this would be the case the Charter would still raise the same problematic issues resulting from the 2000 version. In fact, notwithstanding the fact that one should wait for the Treaty of Lisbon to come into force in order to protect those rights of the Charter that are not yet part of the EU legal system, the prohibition to use the Charter to extend the competences of the EU limits its application to specific purposes. Moreover, the compatibility with the ECHR as interpreted by the Court of Strasbourg still remains an issue and finally the Protocol on the application of the Charter to Poland and the UK demonstrates the will of these two States to prevent any extensive application of the Charter within their legal system.
