Abstract In its judgement dealing with the Lozano case, the Italian Corte di Cassazione has recently stated that functional immunity from jurisdiction of a foreign State should be applied even to military forces belonging to a Multinational Force under United Nations control. Therefore, a soldier who commits a criminal offence in a foreign territory while carrying out his official duties has to be subjected to the exclusive jurisdiction of his national State, in pursuance of the customary international rule which accords to all State organs the immunity from foreign jurisdiction for every act iure imperii that can’t be defined as an international crime. |
