Abstract Cultural regulation is increasingly derived from a stratification of sources of law (national, European, international). Thus, grasping the legal meaning of culture is a necessary precondition for the creation of an efficient legal system This paper concentrates on the interpretation of the term “culture” in legal texts within the “European legal space”, which includes the national, the supranational and the international dimension.The legal concept of culture is itself analysed and critically interpreted through the comparative method. Such a method is the most appropriate for understanding legal concepts and phenomena in the globalized, interconnected world. It strives to pay attention to international treaties, EU regulations and states’experiences, drawing comparative consequences from the functioning of single norms, laws, policies and case law. The analysis concludes by revealing paradigmatic dynamics in the processes of stratification and integration of the sources of law emerging in the European legal space. |
