Abstract This article examines the circulation of the idea of removing the Head of State through a referendum, after a parliamentary deliberation to suspend the President, since the Weimar Constitution up to present days.In particular, the author deals with the unique concrete experience of this type of destitution, activated in Romania in 2007. The analysis of the mechanism to remove the President enlights some procedural requirements. Moreover, in cases of “assolution” of the President by the popular vote, any kind of instrument is contemplated to dissolve the Parliament. These consistent variations respect to the ideal model make possibile to do some considerations on the reception and adaptation of this institute in Romania, besides some observations on the democratic transition and the form of government in this legal system. |
