Abstract Moving from the new objectives of the Lisbon Treaty on European Union (article 3), the paper deals with the connections between social economy and freedom of competition. In particular, the paper wants to demonstrate that the antitrust system has been unchanged and that, in substance, we can ascribe to a simple operation of maquillage the value of a real restoration, smuggling the light changes to the dispositions on the freedom of competition for a substantial change. This way, although the principle of the free competition has been moved in the Protocol n. 27, States members cannot avoid that the rules antitrust dictated for the enterprises are enforceable to their behaviours. |
