Abstract In this essay, the author analyses the Environmental Governance in Canada in order to find some innovative suggestions that could be applicable and suitable also for the Italian model of Environmental Governance. The author points out the lack of any recall to the environmental issue in the Constitution Act of 1982, nor there is an explicit attribution of competence to the Federal or to the Provincial level. Because of this lack the Supreme Court of Canada played a key role interpreting the constitutional provisions in which the environmental issue could be involved and defining a concurrent competence for this subject between the Federal State and Provinces. During this study, the author notices that Canadian Governance of Environment has two distinguishing features: an incentive approach and people’s participation. On the basis of this, the author proposes to apply the same approach to the Italian model of Environmental Governance. |
