Abstract The article, by focusing on the constitutional tradition of pre-communist Romania, has a twofold objective: on the one hand, it aims to stress the differences between the Romanian constitutional experience and that of Eastern European countries considered as a homogeneous group; on the other hand, it aims to discover analogies with the constitutional development of old EU Member States, in order to overcome some traditional East/West clear-cut distinctions. The Romanian constitutional tradition, as results from the historical analysis carried out in this article, is based upon a mixture of external (application of western constitutional models) and internal factors (cultural resistances and particular historical concerns) which were interrelated for over a century, until the beginning of the Soviet political and ideological influence. |
