Abstract The European Court of Human Rights is performing a role of growing importance for the definition of internal legislation concerning human rights. This strong influence is particularly evident with regard to the case analyzed in the article. The Court declared some aspects of the UK antiterrorism legislation – introduced after September 11 bombings in New York – to be inconsistent with the European Convention of Human Rights.The detention of non-citizens for an undefined period of time, derogating from the constitutional set of due process of law, is considered by the Court illegimately discriminatory and not coherent to the dictate of the ECHR. |
