Abstract The regulation of financial markets, particularly in relation to credit and saving institutions, has experienced major changes in the last 20 years. The current legal framework in the United Kingdom has some distinctive features that make it a remarkable model in the European sphere. These features include the principles-based approach to rule-making, the widespread powers of the regulator, the role of the Ombudsman and the protection of the investors through the implementation of “public awareness”. Accordingly, in order to deal with the credit crunch crisis, the US administration has proposed the adoption of a similar approach; however, due to its unique character, transposing the UK regulatory model to other legal systems is unlikely to be successful. |
