Abstract The article analyzes the German debate on constitutional transformations, improved during the Weimar Republic, considering the essential essays of Jellinek, Hsü Dau-Lin, Heller, Smend, Schmitt, Kelsen. That dispute generated the roots of all following discussions in Europe and in Latin-America around constitutional transformations. Moreover, German vocabulary made up the semantic foundations of constitutional comparisons on the point, particularly trough the translations in neo-Latin languages. |
