Abstract The author focuses on the Spanish Constitution to show how it has been modified since 1978 out of the constitutional amendment procedure. In particular, as an example of the most flexible part of the Constitution, the author analyses Title VII, which disciplines the territorial organization of the Spanish State and the phases of its implementation. In conclusion, the author focuses on the case of Catalunya and, more specifically, on the protection of linguistic rights in the Estatuto of Catalunya as a case study of the problematic compatibility of constitutional interpretation and constitutional praxis. |
