Abstract The article deals with the issue of implicit constitutional amendments’ in the Chinese and Japanese legal system. Despite the similar historical background, the two countries have now different legal systems: socialist State China and democratic-pluralistic State Japan. This difference reflects itself on the way the Constitution is enforced in everyday life in both countries. Considering the Chinese case, implicit amendments consist of a mismatch between law in action and law in the books due to the lack of enforcement of the Constitution. In the Japanese case, on the contrary, implicit amendments basically concern the broad interpretation given to article 9 (renunciation of war provision) |
