Abstract The aim of this paper is to demonstrate the unfeasibility of a comprehensive definition of what family is or looks like. The analysis – carried out through a comparative approach – has shown that the family law is very much rooted in tradition and culture heritages. In spite of any attempts of harmonization by the EU legislator, meaningful differences still exist among various legal systems, to the point that hardly can we come across a common path. Even though the Family law, in all legal systems, faces with the same institutions (marriage, filiation, divorce), we can appreciate how the kaleidoscopic combination of human relations leads to Chaos rather than favoring homogeneous legal solutions. The only lesson that we can learn from this multifaceted situation is the one that comes out from the (re)discovery of fundamen- tal rights, as rights that find their reconnaissance through the neoindividualism that characteri- zes the new millennium. |
