Abstract

In Portugal, the legislation on family law has long been conditioned by the Church theorethi- cal formulations and the prevailing principles during the authoritarian regime of the “Estado Novo”. The advent of the First Republic (1910) and especially the adoption of the Constitution of 1976 (resulting from collapse of the authoritarian regime of Salazar) represent the important steps in the process of secularization of the Country, which largely affected the discipline of family law. Since the beginning of the XXI century (especially with the center-left majority leading the Government) profound changes took place in the idea of family, no more in the traditional sense as union between man and woman. The new family models are expressed in the reform of the law about the regime of no-married couples (2001), reproduction and human fertilization (2006), abortion (2007), and, finally, same-sex marriage (2010).
