Abstract The article deals with the family law in the Canadian legal system. First of all, the author considers the allocation of the legislative competence between the Federation and the Pro- vinces: marriage and divorce fall into the exclusive competence of the Federation. Besides the traditional family, the author analyzes the new models of family: same-sex marriage, com- mon-law marriage, mixed couple, polygamy. In particular, the author focuses on the path that led to the legalization of same-sax marriages through the case law of some provincial Courts (British Columbia, Ontario, Québec) and finally throught the federal Civil Marriage Act, 2005. |
