Abstract The Swiss system of family protection is a very interesting from three points of view: first, the allocation of competences between cantons and central government has been reformed thor- ough the constitutional federal reform of 1999; second, Switzerland has to find a difficult bal- ance between constitutional family protection and his immigration rules; third, the new Law of 2005 on homosexual unions (Partenariat enregistré) has completely changed the legal familiar protection, introducing a very special civil status for homosexual couples. All these aspects are analyzed in the light on the CEDH jurisprudence that has always influenced the elaboration of the Swiss constitutional family protection. |
