Abstract Everyone seems to know exactly what he/she means while mentioning his/her family, but defining what a family is gets harder and harder at the beginning of the XXI century. The pre- sent essay aims at analysing rules and practices concerning family in contemporary France. The traditional family model described by the Code of Napoleon of 1804 does not exist any more and the legislator is engaged in a constant dialogue with social actors in order to find new ways of guaranteeing fundamental rights inside different family structures. International principles, constitutional rules, laws and jurisprudence intertwine in the difficult effort of ba- lancing, on the one hand, the need of imposing a normative notion of family, where funda- mental rights are respected and the interests of the weaker subjects (as children and women) are protected; and, on the other hand, the necessity of following society requests of providing legal enforcement to new notions of couple and parenthood. And the cultural diversity brought in by immigration flows contributes to make the overall picture even more complex, and interesting indeed. |
