Abstract This article concerns the Italian constitutional framework about family institution. The Au- thor considers the constitutional idea of natural society and the role of marriage contract and the relationship existing between them. Then, the relationship between the members of a family and the consequences of the marriage are examined. Eventually, the same sex couples “question” is scrutinized in the light of the recent ruling of the Constitutional Court (decision n. 138/2010). |
