Abstract In the modern legal system of Russia and others former Soviet countries, there are many institutes that represent “remnants” of the Soviet legal system. Among those, the large role of the Prokuratura, mainly in the exercise of the “supervisory” functions. Confronting the Soviet law on the Prokuratura and the Russian one we may notice the use of similar wording and structure. The Opinion of the Venice Commission concerning the Russian law is quite nega- tive, considering the mixture of functions that in other European countries are given to differ- ent organs. But it’s necessary to underline that the particular Russian contest requests an insti- tution such as the Prokuratura, because of the lack or the insufficient development of other control mechanisms on the State burocracy. Consequently, citizens would be deprived of an important way of requesting the protection of their rights. |
