Conclusioni.Abstract This article analyses the issue of the independence of the judiciary in the light of the documents elaborated by consultative bodies operating within the ambit of the Council of Europe and the European Network of Councils for the Judiciary established in 2004. Alongside the classical question of the independence of judges, other closely related issues are consid- ered, such as those relating to the disciplinary responsibility and code of conduct of judges, the role and independence of public prosecutors, and the composition and powers of the Councils of the Judiciary. A framework emerges in which significant differences remain be- tween the various state legal systems, but also important similarities and common tendencies on European level may be identified. |
