Conclusioni.Abstract This article deals with the issue of the independence of supranational and international judges, with reference to the Court of Justice of the European Union and the European Court of Human Rights. The analysis starts with a definition of the concept of the independence of the judiciary and the authentically constitutional significance that it takes on also at interna- tional and supranational level. The different types of guarantee of the independence of the judiciary are then classified. Finally, a comparative study is carried out of the procedures for proposing and appointing European judges. Both national and European legislation is dis- cussed, and the differences between the Community system and that established under the European Convention are highlighted, and emphasis is also placed on the common tendency to accentuate the significance of uniform and shared criteria for the designation of candidates by the Members States. This makes it possible to reflect on the role of European judges and their relations, on the one hand, with their Members States of origin and, on the other hand, with the supranational and international institutions within which they work. |
