Abstract

Independence and liability are two of the constitutional law principles that shape Spanish jurisdiction. Both principles apply to the Judicial Branch and to each of its members, i.e. the judges and magistrates that exercise judicial powers under the Constitution. Judicial inde- pendence applies in relation to the remaining courts, especially the higher courts, and in rela- tion to the other branches of state and public institutions. The Consejo General del Poder Judicial is an institution, created by the Spanish Constitution of 1978, that regulates the judiciary and enjoys independence, autonomous status from the other branches of State, and is vested with important powers in regulating the judiciary and upholding the independence of courts. The Consejo is also a disciplinary committee that imposes disciplinary measures against judges and magistrates.
