Abstract This article analyses the regulations of the French Conseil superieur de la magistrature, con- sidering the principal stages in its evolution up until the constitutional reform of 2008. On the one hand, with regard to its composition, the fundamental novelties consist in the end to par- ticipation by the Head of State and the predominance within the Council of lay members. On the other hand, as regards its functions, its competences over disciplinary matters and those relating to the status of judges are discussed, highlighting the differences specified for judges and public prosecutors. Finally, reference is made to the debate currently underway in France on relations between the Parquet and the executive branch. |
