Verso un rinforzo della imparzialità.Abstract This article, which acts as an introduction to the analysis of the various national experi- ences, offers a comparative law framework of organisational models for the judiciary in Europe and the relative guarantees of independence. On the one hand, the experience of the United Kingdom is considered, discussing its complex historical evolution, where the Judiciary can be considered as a political authority. On the other hand, the figure of the judge on the European continent is analysed, where by contrast a bureaucratic model is adopted and judges are regarded as civil servants. Within this context, the author then critically analyses the role which judges have played, above all in recent years, thanks to interpretative activity which often takes on the features of a “law creating” exercise. Finally, several indications are offered with a view to reinforcing the guarantee of the impartiality of the courts. |
