Abstract At the beginning of the twenty-first century Latin American constitutionalism seems to be showing clear signs of vitality, but at the same time, signs of regression and involution. The countries may be divided into 3 broad categories. First, those countries such as Argentina, Brazil, Chile and Uruguay who appear to be consolidating their democracies. Second, those who seem to be extremely fragile from an institutional stand-point and have gone through periods of autocracy (eg. Ecuador and Paraguay). Lastly, those countries, where "democratic dictators", in a populist and military setting, are given (or rather assume) the responsibility of leading their nations towards authentic forms of democracy (as in Peru and Venezuela).
