Abstract The Author compares the regulating of TV programs in the US to the practice of par condicio inItaly (Act n. 28/2000).Even though such concepts as “equal time” and “reasonable access” are not unknown to theAmerican legislator (and to the now repealed “fairness doctrine”), the Author defines Italian parcondicio as “illiberal” and believes the judicial review standards of the American Supreme Courtwould find it unconstitutional. |
