Abstract

This article deals with the development of autorités administratives indépendantes (somehow the equivalent of quangos in England and of independent agencies in the United States) in France. According to the author the traditional background of the French legal system which features a strongly centralized and hierarchical administration with a very influential administrative jurisdiction by the Conseil d’Etat, in connection with the jurisprudence by the Conseil constitutionnel always consistent with the fundamental principles of the system and a mostly respectful legislator have been essential in drawing the lines of a relatively uniform new approach to indipendent public regulation in particularly sensitive areas: up to the point that although the various autorités may appear different, the concept of autorité administratives indépendantes has gained full scientific recognition while the legal system as a whole has been able to place them within the frames of strict legality.
