Abstract The Spanish legal system has several instruments for accessing constitutional justice. One of them entitles 50 members of the House of Representatives or 50 Senators to file an action. A thorough analysis of decisions given during the last twenty years shows that this legal instrument has mainly been used as a means of parliamentary opposition, in spite of efforts by the Constitutional Tribunal to reduce its political use. The jurisprudence of the Constitutional Court has succeeded in using this way of introducing a recurso de inconstitucionalidad in order to objectively guarantee constitutional order. The approach of the Constitutional Court clearly limits the very predictable risks of a procedural act with political characteristics. |
