Abstract The European Convention of Human Rights (ECHR) has both a direct and indirect influence on national administrative law. Direct influence comes through obligations established by the Convention itself and their incorporation into national law. Indirect influence comes through the very important principle of Art. 6 of the ECHR (dealing with judicial procedure) zhich throuth case law of the Court of Human Rights, has also been applied to administrative procedure. The relationship betzeen the ECHR and national administrative law is thus determined by the interpretations of the European Court of Humnan Rights. The Ccourt has also extended the application of the Convention to the relationship betzeen citiwens and public administration. Hozever, since this clearly challenges national prerogatives, it is limited to quasi-judicial administrative proceedings, and may only be applied to cases zhere national authority is not at issue. |
