Abstract Italian Constitutional reform (to be confirmed by referendum) has introduced affirmative action for female electoral representation into regional law. Electoral affirmative action was declared unconstitutional by the Italian Constitutional Court in 1995, but in recent years has appeared in some decisions by the European Court of Justice, in the EC Treaty and in constitutional reforms in other European Countries. Appearing first in the US, affirmative action has since assumed a different role in Europe and in Italy, where it is not to be confused with the principle of substantial equality. The Italian reform raises the question of whether affirmative action is admissible both in regional and national law, and in electoral and social-economic affairs. The answers seems to be yes, but raises many thorny issues. |
