Abstract The work develops a comparative analysis of the decision techniques elaborated by the Constitutional judge in France and Italy for the solution of “complexes” constitutional matters. In France the instrument elaborated by the Conseil constitutionnel is the technique of the decisions sous réserve d’interprétation, which subordinates a decision of constitutionality to the respect of interpretative clauses. These réserves can have an additive, restrictive or directive effect. This decisional technique is compared with various categories of decisions (interpretative, additive, etc.) elaborated by the Italian Corte costituzionale. The work highlights the overall consequences produced by the different organization of constitutional jurisdiction in the comparated systems concerning the examinated question. |
