Abstract In his article, C. Landa analyses the role of political questions both in American and European Supreme Courts or Constitutional Courts, with particular reference to same Latin-American Courts. The political questions represent, according to the Author, the contrast between politics and law. The approach to this issue, that is different in the various countries and also in the historical periods considered, can find in an empirical and functional approach, particularly interested in issues of fundamental rights, a balance between a full abstenstionism and an excessive interventionism. |
