AbstractThe article examines the situation of judicial review of legislation in the Republic of San Marino since its legislative body, the Great and General Council, approved Law number 36 on Feb. 26, 2002, containing the “Revision of Law July 8, 1974 n. 59 “Declaration of Citizen Rights and Fundamental Principles of the San Marino Legal System (ordinamento sanmarinese)”. The system of judicial review of legislation set forth in Law 36, in fact, represents a radical departure from the past (which held up both the thesis of the mixed political-jurisdictional system and that of the political one): now, the “Collegio Garante della costituzionalità delle norme” is at the center of judicial review, with exclusive power to review the constitutionality of regulations, and responsibility for other functions aimed at guaranteeing the supremacy of l. 36/2002 (which for this reason can be considered the new Constitution of San Marino). Examination of Law 36, which, for that matter, is still incomplete, places the current San Marino system in the sphere of the “applicative evolution” of Verfassungsgrichtsbarkeit. |
