AbstractLegislation on the status of aliens suffers the effects of the contrast between the defence of universal human rights and the “protection of the fortress”. In terms of civil freedoms the alien is treated as a human being, independently of his/her status, but with respect to political and social rights his/her condition is very different from that of citizens. Furthermore, all aliens’ rights depend on whether the State permits them to stay in its territory and on the immigration policy. In particular, the latest Italian legislative reforms want to allow immigrants to be admitted if there is actually need for labour; consequently, the alien is increasingly treated as an instrument of work (or even as a dangerous terrorist) and less and less like a human being.
