AbstractThe increase of immigration in Spain has pushed the governments to promulgate a legislation in order to rule this phenomenon. The recent Spanish immigration law is characterized by the need to recognize the fundamental rights only to foreign people that live legally in the state. But this orientation is in contrast with the Spanish Constitution which binds fundamental rights with the principle of human dignity, apart from people’s citizenship.
