Abstract This piece of work reflects on the evolution of the case law of the Spanish Constitutional Court in regard to “interna corporis acta” (i.e., internal parliamentary decisions) with particular reference to the formation of parliamentary groups. In order to achieve its aim, the essay is based on a comment to the Judgment of the Constitutional Court n. 64/2002 of March 11th; in which the Court pronounces on the agreements of the Speaker’s Conference (Mesa del Congreso) in which the formation of the BNG parliamentary group was refused. This was a controversial decision because this organ of the Chamber does not allow the common practice of so-called “loaning of parliamentarians” which although against the parliamentary standing orders (Reglamento parlamentario) has always been accepted (even during the present electoral term of the Parliament) by the majority of the political forces in the Chamber. The authors argue that the “loan of parliamentarians” to form a parliamentary group is a fraud of law which is prejudicial to the fundamental rights of the members of Parliament and can therefore be reviewed by the Constitutional Court. |
