Abstract This article deals with the more recent problems related to the system of European sources of law resulting from the draft of the European Constitutional Treaty. In particular it illustrates the new hierarchy of legal sources which includes both legislative and executive acts as is the case in numerous Member States. Subsequently the article analyses the procedures employed to adopt the various sources and the involvement of the Community organs. Special attention is paid to the mechanisms used to ensure the implementation of the principles of subsidariety and proportionality. Finally the article examines the problems related to the involvment of the European Parliament in adopting European legal sources. |
